The establishment really has you hoodwinked, doesn't it? I don't know about where you live, but around here, the cops can do anything they want when they want, as I'm sure the cops in Oro Valley do. That includes writing anything they want onto a speeding ticket (or any other citation-arrest report) regardless of what you were actually doing for what ever reason they want to; be it that they need to make quota, that you skin is too dark for their tastes or that they simply don't like you.

"don't let it get aboove 40," eh? And if that cop feels like it he can stop you, and write anything he wants onto that ticket (say 41 or 51 or 91 for that matter) and there is nothing you can do - it will be your word against his and the court will presume you a liar and the cop correct.
