And, BTW, I'd rather have none of these drugs being illegal. This new prohibition causes more misery than the complete legalization of these drugs could possibly cause.
We're protecting that guilty man's rights, and by doing so, protecting our own rights. Our system of justice abhors an unjust conviction. We feel it is better to let 10 guilty people go than to convict 1 innocent man. It ain't perfect, but its the best thing we have.
Well, how then do you keep the cops from riding roughshod over everyone's rights? They collect evidence illegally, knowing at the time it is illegal, then just say, "oops", and the courts then use that evidence? That would simply say that there is no need to protect citizen's rights, and that cops can violate the consbreastution at will with no consequences at all.
Do we want to switch approaches, and start putting cops in jail for what might actually have been an honest mistake in the interpretation of the law? I think that maybe we shortly would not have anyone willing to do the cop job for fear of ending up in jail for simply making a mistake.

No, the way it is being handled I think is the way it should be handled. Violate someone's rights, and you don't get to use the evidence you obtained while doing it.
