The requirement to keep your vehicle in a road-worthy condition, to obey traffic laws, not to drive dangerously or recklessly, etc.
OK - I accept that.
OK - so what you are saying is that it is perfectly right and proper for you to be convicted of speeding when you are photographed at the scene - but not ok for you to be convicted of speeding, even though you *were* actually speeding, unless there is some other evidence that you were at the scene? Apart from tradition and the rules thereof - why should it be right for you to avoid conviction for an offence you have committed?
Well that's where we have to part company because I consider it essential that the laws governing our use of motor vehicles on the road are enforced
The keeper of a vehicle is not
Well, I'm not so sure. The 'reasonable diligence' excuse is there in the legislation and others have used it successfully (if dishonestly at times!) Just as a matter of interest - do you consider it acceptable to lie to avoid conviction?
See above. It *is* valid if true.
Even if the keeper is the driver and thereby 'incriminating' himself?
I have a bigger problem with the fact that the answer
See above. It *is* acceptable if genuine and honest.
Only in as much as Gatso evidence is virtually impossible to dispute.
Only because of the strength of Gatso evidence. You are not prevented from disputing the evidence - in fact you have every right to. It's simply that you are unlikely to be successful!
Agreed.
Driver Notification forms for Mark! 5090Uno Hoo! in response to: I don't think I was saying precisely what you were saying. The courts will not convict an alleged burglar merely on suspicion. Either some...
But is that basic premise actually beneficial to anyone other than law-breakers?
Ok, well I think we've built some bridges of agreement - although are still far apart on the Gatso matter. I suppose the difference is simply in outlook and atbreastude. If I was caught by a Gatso camera (and the possibility is always there despite my best efforts!), and I received the driver notification form then I would have no problem or hesitation in completing it and paying my fine. I would not be happy about paying a fine, of course, but because I believe in the law and justice I recognise that if I transgress I should pay the penalty and not try to avoid it. I believe that guilty people should be punished. I do not believe that guilty people should be able to avoid justice by taking advantage of any aspect of the justice system which allows them to do that. As I've stated before - the justice system, to my mind, is not a 'game' where the main intention is to avoid conviction by any means and at any cost. The justice system is there for the benefit of society as a whole and the main intention should be to convict the guilty and protect the innocent. The problem with many aspects of the justice system is that they protect the guilty at the expense of the innocent.
