I don't need to Mark. So long as I can demonstrate that I was not driving the car and, despite due diligence, have no means of knowing who was driving my car, I have committed no offences and cannot be charged with anything. You appear to be under the misapprehension that any owner who cannot *prove* that he was not committing an offence will automatically be charged with that offence. This is far from the truth. The police are not stupid (despite what you may think!) and in the majority of cases they can tell who is lying and who isn't. In the example above - even if my wife had not been able to corroborate my location - I simply do not believe that anyone could break into my garage, break into my car, take it away, and then return it to its exact same position (which is not easy in my garage!) without me being able to determine that it had been moved by someone other than myself. You can come up with all these fanciful hypothetical situations but in real life they very very rarely happen. As I've already pointed out - S172 has been around for over 30 years without problem.
