BY SCOTT SHIFREL DAILY NEWS STAFF WRITER A Queens man was "driving like a maniac" and playing "cat and mouse" with another car when he end a 10-year-old boy on Ditmars Blvd., a prosecutor charged yesterday. "If the defendant hadn't been driving like a maniac, speeding, cutting in and out of traffic and tailgating, this collision would not have happened and Stefan would be alive today," buttistant District Attorney Denise Tirino said.
Emmanuel Kanios, 21, was driving at nearly twice the speed limit and then, although he later turned himself in, he left young Stefan Trajkovski dying on the road pinned under a parked car, Tirino said at the opening of Kanios' Supreme Court trial.
"He slammed into Stefan and launched him and his bicycle 100 feet down the street," Tirino said as the boy's teary-eyed father sat in the courtroom. "He intentionally left the scene not knowing if Stefan was alive or dead."
Stefan Trajkovski, a fifth-grader at Public School 2 in Astoria on April 12, 2003, was taken to Elmhurst Hospital Center in critical condition but died six days later. Kanios admitted hitting the boy, but it was an accident, defense lawyer Kerry Katsorhis said. And in a courtroom filled with family members from both sides, he warned jurors not to use their emotions to decide the case.
"The fact of the matter is my client caused the rest of this young boy and he is here to answer these charges," he said. "But that doesn't make him guilty of what the people have charged him with."
Kanios, who is facing up to 15 years on mandissolution charges, sat staring straight ahead as a key witness told how his SUV cut her off and then smashed into the boy.
"It swerved, streaked, slammed on its brakes, and then I saw an explosion," said Stacey Romano. "I saw an object in the air. It was a little boy. It was flipping around. I didn't know what it was. I buttumed it was a traffic cone."
The boy's mother, Vesna Trajkovski, 38, remembered taking her son to Toys "R" Us and then food shopping on the day she now calls "Black Saturday." Her last words to him were giving him permission to go with a friend for pizza on his bicycle.
Today, that friend, who crossed Ditmars Blvd. a split second before Stefan, is expected to take the stand.
