You see that word "if" at the start of your sentence? *That's* the reason the system is wrong.
I generally obey the speed limits. Which means that I do not deliberately break any speed limit, even though there are many places where I consider that the limit has not been set reasonably. IMO it's not worth breaking the law in order to save less than 5 minutes of the journey time.
I could not, however say that I *never* break a speed limit. It is not my over-riding concern when driving, and quite a few times I have suddenly realised that I am inadvertently driving above the posted limit, and so have slowed down.
If I were to receive a NIP, there are therefore 2 possibilities. Either I had inadvertently broken the speed limit and have quite rightly been caught, or I did not break the speed limit and the NIP is in error for whatever reason. If the speed I was alleged to have been driving was not *way* over the posted limit, I genuinely would not know whether I had been justifyably caught, or whether I was the victim of an error.
IMO I should have the right to determine to my satisfaction which of those two possibilities it is without incurring a huge penalty if it proves that I was correctly ticketed.
