If you get photographed by a Gatso, either go the PACE letter route and insist that the letter not be used in court, or simply go for a day in court and claim to have forgotten who was driving. All Plod have to go on is a picture of the arse-end of the car; no pic of your face so let them prove their case.
The CPS these days are getting rather wary of prosecuting for failure to say who the driver is, too; could it be that they're afraid of someone taking this to the European Courts (again) for being an illegal violation of the right to silence? Were that to happen, every Gatso in the country would become obsolete overnight, and need replacing with Truvelo units, and most Scamera vans would similarly become obsolescent.
In short, the only reason this party can continue is because of motorist apathy and the illegal forced confession scam. Knock out the forced confession and the whole sorry edifice crumbles.
