I can't wait to hear this response. When he recognizes that the same reason you can't do this and get a conviction is the same reason you should not search lockers at school, and get a conviction, maybe he will wise up.
But I doubt it.
So, let me explain. The locker at the gym belongs to - now watch - THE OWNERS OF THE GYM. Can you figure out who the school lockers belong to?
Now, the previous user of the locker could have left something in the locker, or could have left - get this - THE ODOR FROM WHAT THEY HAD IN THE LOCKER. So the dog could alert on the joint that the previous locker user had stored there before he left 10 minutes ago, and now the current user gets arrested.
The school locker is worse. Who has access to the school's locker? Well, ANYONE IN THE SCHOOL SYSTEM that happens to dislike the kid, or that knows someone who has access. What is to stop a teacher from depositing drugs in a locker, having the cops search it, and getting a kid he dislikes out of school into jail?
But Jaybird and other cops, lawyers, judges and juries have been too f***ing dumb to realize that fact.
