Tampered? Who said it's tampered? A dead chip means a dead chip. Chips die; a fair proportion of their own accord.
If the officer cannot read the licence, then that's a problem of literacy. If the machine cannot read the chip, then that's a minor technical issue. Which could be the fault of the reader, the USER, or the chip.
In order for somebody to be locked, there has to be a reasonable evidence that the person being imprisoned has actually done an ill deed. Given that the maximum probability of damage is when the document is being handed over for *reading* by an authority, such a situation would quickly become socially unacceptable.
