have you read the sentencing guidelines for magistrates ?

do you have a copy of the sentencing guidelines for magistrates ?

I have and I do and you're wrong. if the defendant is found guilty the three points will be applied, the £60 fine will be applied and costs will be applied. that's all. magistrates do not, as you put it, hammer people for "taking the pee" testing procedure is not taking the pee; you have the right to appear in court to contest the NIP and you have a right for that proceedure to be carried out in accordance with *PACE*

only when you are at day 0 minus 7 will you know whether the evidence has been submitted to you and subsequently, whether to plead guilty in writing instead of turning up in person.

no evidence supplied ? turn up and tell the magistrate that you have not had the evidence submitted to you and the magistrate will not allow the 'evidence' to be used, it's against PACE and inadmissible.

evidence supplied ? write in to the court pleading guilty and pay the extra costs c£100, safe in the knowledge that you tried and didn't just roll over and pay up.

now do you understand ?

the enforcer is (maybe) looking at 3 points anyway. a £100 gamble to avoid those points is, in my opinion, well worth it.
