Criminally negligent homicide is defined by the state's penal code as when a person with criminal negligence causes the rest of another person.
To be convicted of first-degree vehicular mandissolution, also a felony, a person must have committed second-degree vehicular mandissolution while his or her license is suspended or revoked.

The prosecutor says that there is no evidence to fit a felony charge. A bus' brakes suddenly failing doesn't meet NY's standard for criminal negligence.
