We have based our driving laws on fact, but thresholds are required for enforcement. It's really very simple my friend - we have decided that 65mph is fast enough for most drivers. If you choose to drive 25 mph faster be prepared for sone hefty financial damage. Whether it is called dangerous, reckless, stupid, self-centered or risky driving is pretty much irrelevant - we can give the behaviour any name as long as the punishment is sufficiently harsh. That the driver in question violated one or more traffic laws is the key.
Sure - the basis is that we as a group have decided that very few drivers possess the skills required to control and stop a car at that speed. That is a fact - there is a law in place. Violate it and you risk some hefty financial damage. Period.
When someone is willing to pay a big fine in lieu of points means the pain isn't sufficient to deter the behaviour. Just make the pain sufficient with a combination of points, fine and increased insurance premiums and the individual will ultimately drive properly...or he won't be able to afford it. If someone is willing to make the wrong choice often enough to cause them financial harm, well I have no sympathy...I hope they go completely bust.
Naw, I'm for a lot of pain quickly to cause the individual to stop inherently dangerous behavour before he hurts someone else.
