Except when it's not illegal, which is most of the time. The only time it's illegal to drive in the left lane in Colorado is a) on a highway with a speed limit of 65 or greater, and b) there is no traffic in the lane to the right that would cause a merge to the right to be unsafe. In my judgment, that means no vehicles within 330 feet ahead or behind in the lane I intend to merge into. Absent that 660 foot gap, I can drive in the left lane all day long if I like and be in perfect compliance with the law.
And so long as it's legal to drive in the left lane, then any unsafe condition resulting from traffic buildups behind a lawful left lane driver is the fault of the unlawful drivers behind him. I say unlawful not because they are, at that moment, speeding, but because they are following too closely, which is also unlawful. The fact that someone is in front of you, even if they are unlawfully impeding traffic at the time does not excuse unlawful, unsafe driving behavior of the people following. They must STILL slow down, get in line and wait their turn.
