And, as such, was (it could be resonably buttumed) was waiting for traffic to clear before making an (unsignalled) turn. How is this different? Only in the eventual outcome, not in the actual run-up to the eventuality.
Making even eye contact isn't a guarantee the other driver won't do something stupid. I had eye contact in 91 when a lady made a left into the side of my truck. She saw me, admitted she saw me, and told the cop she thought I was going to stop to let her go(??). If you really do slow to a crawl at intersections whith drivers waiting to make left turns, I must wonder how many times you've been responsible for making other drivers do stupid things in order to get around you.
The cluies were that the driver was slowing for something. What that something was remained a mystery until he turned. If he hadn't actually made the stupid turn, that something may still be a mystery to all but the driver (and maybe even him). If you were to drive as though every driver would always make the wrong move, you'd never get out of your driveway.
