Wouldn't work. Remember, the road is a shortcut between two major roads, one of which is a highway. Fence it off, and your own workers can't get to-from work, as those two major roads are literally the only way in-out of the area. A gate would also not be practical, unless it was manned (and all employee cars were conspicuously marked somehow), which would cost money, obviously. Some kind of fastlane technology (like collects tolls, but programmed to open a gate instead) might work. But again, that would be wicked expensive to implement. You'd have to have a system that would allow access to the employees to both major roads with no more than a second or two delay for each vehicle (or traffic would back up for MILES twice a day), yet at the same time prevent non-employees from driving through.
I doubt if the private owner would be suable if there was an accident on that stretch. Yes, theoretically, you can sue somebody for just about anything, if it happens on their property. But the more likely target of a lawsuit would be the driver of the car that was legally (but stupidly) doing 50MPH through what amounts to a parking lot. -Dave
