The driver in question, accepting the facts as stated, was not driving without a licence. He was driving outwith its terms. Some countries don't have a requirement for an accompanying driver for learners (indeed, the UK doesn't, for some sorts of motor vehicle). There was a time in the UK when there was (in effect) no such thing as a "learner driver", and one of our nearest neighbours only introduced tests a few years ago. The difference between the UK in (say) 1930 and the UK today is an administrative change and nothing else. That is not to condone driving whilst unaccompanied; it is simply setting the situation within the correct context.

That could happen even if they were lawfully accompanied (and remember: the "accompanying driver" can be asleep on the back seat - or in a bunk if the "car" is a caravanette). And is driving without due care and attention the preserve of learner drivers who happen to be unaccompanied? I have even heard of similar incidents involving *qualified* drivers.

Driving whilst unaccompanied and DWDCAA are two separate issues. The DWDCAA does not make the driving whilst unaccompanied any worse or any better. And the commission of one offence does not remove the offender's general rights or protections under the law.
