If there was somebody gaining on me in Lane 1 i would see him and keep out of his way. I do use my mirrors you know, unlike some people! And of course it would be very dangerous for my MLOC to move into Lane 1 whilst someone was overtaking him on the left, so I wouln't then want to give the "hint".
Talking of which, I was nearly had twice today by people who didn't use their mirrors.
Incident 1 was in the road works on the M1, where I had just joined and wished to pull out from lane 2 into lane 3 to avoid the tailback in lane 1 for the next junction. I sawe a suitable gap, signalled and started to pull out at the same time as someone in Lane 4 also moved towards it. I pulled back into Lane 2, I don't think the other driver even saw me.

Incident 2, leaving this motorway in the RH lane of a 2 lane slip road, I was gaining on and about to overtake a Rover 75 in lane 1 when he suddenly pulled out in front of me. I braked and moved into lane 1, which was then empty.
I drove more or less alongside the Rover to the roundabout at the end of the slip road, and we both took the same exit, still alongside. At this point the Rover attempted to move into Lane one despite the fact I was alongside him, fortunately he saw me before he had completed the move, and a small deviation to the left was all I needed to avoid him.
As I said to my pbuttenger, "I think they are out to get me today".
