How on earth can you be prosecuted for undertaking in this situation? because the HC specifies only two conditions in which you can undertake, that isnt one of them.

Neither the law nor the HC says anything about monitoring the speed of the traffic to your right to ensure you don't go ahead of them. Nor do they say that if all the other drivers (in the RH lane) are acting incorrectly, you must also.

CLEARLY there's only one driver at fault here - it's the knob in L3. If the law says you shouldnt undertake except in the conditions it quotes then there may be two drivers at fault.

The law says nothing about it. However where conflicting advice is given in the HC, the common sense option is the one to choose. Otherwise a vehicle doing 40 in the RH lane of a motorway would cause a rolling road block since no one could pbutt him in any lane.

This is not rocket science.
