Neither the law nor the HC says anything about monitoring the speed of the traffic to your right to ensure you don't go ahead of them. Nor do they say that if all the other drivers (in the RH lane) are acting incorrectly, you must also. Yes, but if you are pbutting slower traffic, then you are overtaking (regardless of where that slower traffic is)......... No you're not. Overtaking something is not the same as pbutting it. Overtaking is a deliberate planned manoeuvre which requires a change of lane, pbutting the other vehicle, then a return to your original lane. Some people do this using the lane to their left (commonly called 'undertaking'), something which is frowned upon. This is not the same as progressing ahead of traffic to your right, (which may be moving slower or stationary) whilst driving perfectly correctly and in accordance with the HC. I don't think that's right. Pbutting-overtaking are synonyms out on the road. You can overtake without changing lane. The Highway Code has several mentions of the term used in that sense.
Yes but where the HC points out that one shouldn't overtake, or that one should not overtake on the left, it is obvious that it is referring to the above deliberate manoeuvre, rather than forbidding LH lane traffic from moving faster than that in the RH lane, as would be the case using some peoples interpretation.
