that's what they tell you what actually happens is a different matter.

the last time I was involved in a collision my insurers legal advisory team (RAC) advised me that they see narrow lane collisions every day and they always go 50-50. in my case there were no independent witnesses but there was my mum and my mrs in my car with me.

the other driver was going too fast when he saw me (I was doing 25mph) and the other guy locked up and skidded into me. he apologised on the spot but I didn't. I took photos with my V3, he didn't. I gave a truthful statement to my insurance company, he lied and claimed that I'd hit him

the RAC advised me to go 50-50 and the solicitors also advised me to go 50-50 but as I was going to lose my hard won NCB I had nothing to lose and told the solicitors to sue and the RAC to pi$$ right off.

I didn't hear anything for 2 months and the day before I was going to call the solicitors to see what was up I got a cheque for my excess and a letter saying that the other driver had admitted liability and my NCB was reinstated.
