Lets be clear that we're both talking about pushing the vehicle and switching positions.
That is minimally dangerous because the car is going so very slow. I could stand in front of a car being pushed like that and stop it with my hand.
Its because the original pbuttenger is getting charged with DUI for doing this minimally dangerous and also necessary thing in buttisting in getting the car off the road. It was night. The car could have been hit by a third party. That would actually be dangerous, not only to the third party but to the women as well if they were anywhere near the car. The right thing to do in this situation is to get the car off the road. They should not be punished for doing the right thing. The original driver can be charged with DUI for driving the car up until the engine quit - I have no problem with that. The pbuttenger can be charged with simple public intoxication - I have a little problem with that, since she intended to be inside the car, and, as a pbuttenger, it doesn't necessarily fit my idea of "public" nor do I believe the really over-the-top, ultra-low 0.08% BAC is a proper standard for public intoxication. Public intoxication is being so looped that you are an obnoxious buffon, or a falling-down hazard to yourself and others. Again, if 0.08% was chargable with PI, then the idea of a designated driver is negated - you might as well go ahead and drive if you're going to get arrested anyway.

Well, I don't much care about DUI laws because I don't drink but once or twice a year, with people who drink at a meal, but using the legal system for the purpose of a simple prosecution to further the career of everyone involved while doing injustice is what I have a problem with. I always have a problem with injustice no matter who's doing it, but maybe even more because its the cops doing it and they have too much power to be doing it. The pbuttenger is not guilty of doing anything that shouldn't have been done. They should have removed the car from the roadway, and they did, in the only manner available to them. There was no other reasonable choice. And pushing a car that doesn't have the ability to run over and kill someone at the pace they were necessarily pushing it isn't a dangerous thing to do. Best you might get out of being hit by a car like that would be a sprain, and it'd still be your own fault for not moving out of the way of something going so slow.
