If it's rolling down a slight incline there will be no huffing and puffing, as the car will be rolling away from the pushers.

It doesn't even have to be a *perceptible* slope for a car to start rolling on its own.
Obviously you have no experience with what you're talking about. Having helped push various nonfunctional vehicles in preparation for either parting out or restoration, you discover that subtleties of terrain that the average person don't even notice suddenly become of prime importance. A car with radial tires, non-dragging brakes, and no other mechanical problems, in neutral, will roll quite freely.
Obviously, someone WASN'T smart enough to do all the right things as they hit something.
How do you know? It's just as likely that there was as not.
It's dead right. You don't take control of a vehicle when drunk. Period. Now I might argue a bit about BAC limits etc. and the actual definition of "drunk" but in this case it is clear that the correct charges were filed.
How did the car get in the middle of the road to begin with? By DUI.
