And the bridge at the bottom of the hill is where the car would have quit moving after the engine quit. 1 single woman pushing isn't likely to have moved it anywhere after that - its too much work.

Indiana's pretty damn flat most places other than the southern part, and Portage isn't southern Indiana. And, if there was a grade that would cause the car to roll, they wouldn't have bothered to push it - they'd have coasted. If the grade was in the other direction, they likely wouldn't have been strong enough to push it any significant distance - that's a lot of work even for large men.

As I said in another post, it stops, you fall down because you weren't expecting that and lose your balance, and its gonna roll away for a while until you can get up and go chase it. In a small area like a parking lot, it just may hit something before you catch it.

"They should be punished," you say. I wonder how you would feel about punishing them if they had done as you seem to prefer and left the car in the road and the next car that came along hit it and the occupants were end? How about if one of the occupants were your kid? Should they be punished for leaving the car in the road?

I'd say pushing is great evidence that it was necessary. According to some here, if there's even the slightest grate, it'll roll away by itself. Hmmm... wonder which it really is.

Apparently he things that people on the jury may have a sense of justice and fail to convict.

Yet the prosecutor says he feels challenged with respect to making this stick in court. Why do you suppose he said that? Maybe 'cuz its not so cut and dried as you think it is? Hmmmm?

All hail the letter of the law, and to hell with justice, eh? Well, that's what jury nullification is all about, and what we may see if this goes to trial.

Again, how would you feel about these two if they had left the car in the road and someone you care about was in a car that hit it and was end? Would you think they did the right thing to leave it in the road just because they would violate the letter of a law that wasn't really meant to address such a situation? None of this nonsense about "They shouldn't have been there in the 1st place," because we already know that. The situation is that the car has stalled and is inoparable in the road. You really want 'em to leave it there, even tho they're capable of moving it, just because of what some law says, and now your significant other mother father son daughter good friend is dead because of it? Is that what you really want?
