Again, the car hit an irregularity in the parking lot, rolled backwards, and they just couldn't catch it in time. Some sober people might not have caught it either.

Well, I don't think its cut and dried at all. I think its real shakey, and nowhere near the situation that the legislature had in mind when they pbutted the law.
Not a big deal. I have insurance. He's not even guilty of DUI since he can't even be said to be in control of the vehicle, nor did he even have an intent to move it. It was a true accident. Of course, to someone with your punitive nature, even an accident must be punished - so I guess we should whip him into jail just because he bumped the shift lever and the car started rolling on its own.
There's no law against being stupid. If there was, half the population would be in jail.
Well, the driver does - the pbuttenger was doing the right thing by not driving, although she was doing a risky thing (and she has a right to choose her own risks, BTW) by riding with a drunk.
The car caused the property damage, but nothing nearly as serious as that which it would have caused if it had been left in the middle of the road and been hit, not to mention maybe killing someone.
They broke the letter of the law, but not the spirit of the law, I say. The spirit of the law is to prevent someone from getting in a car, starting the engine, and going driving about at normal highway speeds.
No, it isn't - hence the prosecutor's misgivings about making the charge stick in court.

How big of you - and as a matter of fact, they did. Nobody was hurt. Property damage is irrelavent - cars don't bleed, and can be painted and repaired and even replaced.
Yeah, yeah, yeah - when you know your up a tree, attack the messenger. They did the right thing in making the roadway safe for the next car to come along. I know it, you know it, and yet you persist.
The pbuttenger is not worthy of DUI, that's all. I can see public intoxication, but nothing more. The reason I'm so quick is that I absolutely despise injustices, and a DUI in this case would be one.
You seem to be unable to put yourself in their place, ask yourself what you would do, and find that you would have done the exact same thing. OK, lemme make it simple for you: You're lit up to 0.15, riding in a car as a pbuttenger, the engine quits, and you have to make a decision. Do you A) walk away and let the car be hit, possibly killing someone, and maybe somone you know, or B) help the driver get the damn thing off the road? I choose B. How 'bout you?
Yeah, run away - you know your position is indefensible - great solution.
