Dave Head He didn't have to be driving the car - just in a position where he could knock the shifter. That normally implies behind the wheel. The kind of activity...

Yes, it IS a big deal. It's going to cost you, in time, hbuttle, and probably money, even if you do have insurance. But lots of people don't have anything more than basic liability, so if dumbbutt bolts, they're butt out.

sure he is.

Last time I checked, losing control of a vehicle when you're behind the wheel was an offense.

No, he didn't. Do you think that intent to cause damage in any way mitigates the fact that damage was caused? Is that going to repair your car? Is this IN ANY WAY different than if he sideswiped you at low speed in traffic? Other than the fact that the latter case would have happened on a road and not a parking lot, no.

At less than a walking pace. Big deal. There's no reasonable explanation for bothering with...

No, it wasn't. When you get behind the wheel of a car and aren't 100% sharp, and something bad happens, it's not an accident - it could have been easily prevented by a) not drinking or b) not getting behind the wheel. Quite simply, if the guy wasn't clearheaded enough to get his foot on the brake pedal as soon as he felt the car beginning to roll, he was impaired enough that he had no business being in the driver's seat AT ALL.

My punitive nature? Oh, my, now I guess we should start not ticketing people for not signalling lane changes because they *meant* to signal, but just didn't. And perhaps we should stop pulling people over for equipment violations because they didn't *mean* to drive with both taillights burnt out, they just haven't checked them in over a year. And perhaps we should start cutting people slack when they change lanes into another car because they *meant* to check their mirrors but just forgot.

I can't believe in this day and age, when we've had untold resources (disproportionally, and to the detriment of other necessary safety initiatives) dedicated to making people aware that drinking and getting behind the wheel of a car is a) a bad idea, because it's dangerous and b) illegal, and subject to Draconian penalties that you could possibly defend anyone that has caused damage by doing just what is clearly proscribed.

Now just to wait until my real news server comes back up so all this drivel will just magically disappear... (killfiles for Google groups. It could be big. You read it here first.)

Not acceptable - I'm setting the parameters of this experiment, not you. I didn't say that. But...
