Yes they are - just ask any pothead who has been busted for possesion of a bag in the glove box.
This is not relavant - just as the keys could be obtained by simply opening the glove box again and retrieving them, I could get out, walk around to the driver's seat, and drive.
Look, we're arguing over a really stupid concept of buttuming that if someone can do something, that they will do something and should be punished for it in advance. The law is just nuts. I don't see how we could have anything execpt a nutty conversation about it, unless we were talking about maybe repealing it.
I didn't say anything about pointless. And what is weird here is the concept of punishing people for doing the right thing. They changed a very dangerous situation, a car stalled in the road, into non-dangerous situation, a car parked in a motel lot. They did the right thing. There should be no punishment for doing the right thing.
Again, this is absolutely buttinine. Its no different than buttuming that just because Al Capone was Italian and ran a bootleg alcohol crime ring, that any Italian is going to run a bootleg crime ring and should be punished in advance for doing it.
Wanna arrest someone for DUI? Then catch them driving while drunk.
I wasn't "lucky", I was in control - I can talk and drive, and I can walk and chew gum at the same time. Fairly equivalent tasks. And, I arranged the situation so nothing could happen - I was probably 75 yards behind that car while I was talking and driving. He could have done a full panic stop and I still wouldn't have hit him.
