Getting busted for DUI for "driving" a car that has no operable engine is about as nuts as getting busted for pushing a car that maybe has an operable engine. Neither makes a lick of sense. Its just an opportuity for the cop with no common sense and too much ambition to get another arrest to maybe further his career.
Well, they're still in the car drunk... sleeping... like the roomate in the car in the driveway after the fight with the roomate. None has an intent to drive, but the roomate gets arrested - why not these guys? Makes no sense, any of it.
Well, if you're going to get busted anyway, for nutty stuff like sleeping in your car in order to achieve sobriety some hours later, you might as well profit from being illegal, eh?
The law is backwards when it ends with people with no criminal intent, such as sleeping in a car to achieve sobriety, or pushing a car off the road so it wouldn't get hit, or even recueing a swimmer from fast moving water, and not having a few years to spend in a law library to attempt to figure out how some cop is going to warp a law against all common sense, getting arrested.
