Yes, one did. That person can be charged with DUI - I have no problem with that. I'm just pretty outraged by the charging of the pbuttenger. She was just buttisting in getting a dangerous obstacle off the road.
Yep. A pretty good idea, if your suspected of something, is to not say anything.
Well, I'm not so concerned about definitions as what the legislature intended. Clearly, no one in the legislature would have intended to take someone's license for a year, and maybe even put 'em in jail for almost a year, for pushing a car, no matter if they were falling down blind drunk. Keeping to the letter of the law unless it is in the defendant's favor I think is almost always a bad idea. The great object of our legal system is to NOT punish the innocent - allow 100 actual perpetrators to go free rather than to punish 1 person wrongly.
