Its because if I agree that its a motor vehicle, then it appears that I'm agreeing that the woman who was a pbuttenger deserves to be charged with DUI for steering it while its being pushed. Since that is an UNJUST thing to do, because she was posing no hazard to anyone and in fact removing a hazard from the roadway, I won't concede that the law was meant to apply to this situation. The local prosecutor also believes that its going to be a tough sell in court, as well it should.
Y'all should just get over it - I'm sure their defense attorney is going to come up with a similar line of reasoning for the purposes of defending their DUI in court, and... it'll probably fly. I think they'll get off, at least on the pushing thing - as they should - but the original driver might have a problem with what she was doing before the engine quit.
As for "losing the debate" I don't really care. I am absolutely certain of my sense of justice in this matter, and these people do not deserve to lose their licenses for a year and maybe go to jail for a year for pushing a car off the road and thus removing a dangerous situation from the roadway. You don't have to believe me, but I'm still correct in this. I'll chalk it up to an inability to persuade (maybe I should take a clbutt or something) rather than a fault in my perception of justice in the situation. The driver should get a DUI for what happened before the engine quit, the pbuttenger a public intoxication, and that's about it.
