Well, yeah, and an adult can be end by simply falling over if he-she hits their head on something solid. The world's a dangerous place.
They were doing it at 12:23 AM according to the police report. Not a lot of chance of any sort of pedestrians around, esp. kids.
Well, reading the story, the prosecutor feels like he may have a hard time making this one stick. I actually hope he finds it impossible. The only thing wrong with that would be a missed opportunity to do the right thing, and give the 2 a decent fine and maybe a few days in jail to wake 'em up.

to see what really happened. Yeah, one of 'em was driving it when it simply stopped. They were pushing it off the road and into a parking lot, when it rolled backwards and they couldn't catch it before it struck another car.
With this further info, I would go along with a DUI for whichever person was actually driving the car before it quite, but not the other person who was simply steering or pushing it, either one, to get it off the road and out of the way of traffic. That was the right thing to do no matter how lit-up a person is, as you don't want a disabled car in the lane of travel, or even along the side of the road if you can avoid it. (Drunks see the tail-light reflectors, and line up on it, even if its parked on the side of the road, sometimes.)
