I was recently a victim of a hit and run accident in San Jose, California. A trailer attached to a small truck came lose and struck the front of my car causing complete damage. I don't have collision insurance on this car, 1998 Saturn. Accidentl happened in Nov 2005, no injuries, the hot and run driver left the trailer behind.
CHP found that the licence plate number on the trailer goes to a Pest Control company with PO Box **** in Cuptertino, CA. CHP inquired with Cupertino Chamber of Commerce and with US Post Office and found that no company with that name exists.
I recently found from the dept of comsumer affairs (DCA) that a company with the name does exist and had-has the same po box in cupertino. However, the DCA website shows that the company (a franchise) no longer has a license (cancelled status). Terminix owns all franchises with that name in other parts of bay area, california.

So question is: Who can I blame buttuming that the driver might never be found but the trailer is register to a possibly defunct franchise.
What are my options? Should I even consult a lawyer for this? Should I sue the company, last owner of the franchise if I find their information somehow? Who is legally responsible for the trailer that hit me and who can be sued?
