Using a hands free setup isn't a major issue (unless someone delivers very bad news to the driver unexpectedly). A safety case with a bus crash involved such an incident.
I am appalled at the number of high milage drivers that do not have hands free installed.
Double the penalty when some prat driver using a mobile phone is involved in a crash. I have had too many near misses with oncoming vehicles veering onto the wrong side of the road thanks to their loss of concentration whist on the phone to be forgiving.
And it seems to be the very worst drivers that think nothing of turning to face their pbuttenger whilst holding a conversation or using a mobile phone oblivious to the world around them (or worse still texting!!!). It is usually very obvious when they drift out by more than half a lane that they are doing something pretty stupid and distracting...
Making handmade roll up cigarettes, applying make-up and-or shaving in the rearview mirror should all be similar offences. Problem for the police is catching them at it. At least the mobile phone log will show a call in progress at the time of the collision.
