Speed blunder could cost police

Wiltshire Police could face a bill of more than £1m to pay back speed camera fines after a court challenge.

Those caught at the A303 Folly Bottom roadworks between May 2003 and August 2004 can now apply to have fines and penalty points reviewed.

The move follows a court case where a woman caught speeding had her case dismissed by magistrates after she claimed there were no warning signs.

A police spokeswoman said each case could cost up to £250 to process.

The Wiltshire and Swindon Road Safety Partnership said any driver caught speeding on the A303 at the Folly Bottom roadworks between May 2003 and August 2004 could apply to have their case reviewed.

'Consequential loss'

Paul Smith from the Safe Speed Road Safety campaign said he encouraged those caught to take independent legal advice.

"If anyone has suffered any consequential loss, for example the loss of your driving licence or employment then they should consider claiming compensation," he said.

The action follows the case of Clair Allison who was caught on camera exceeding a temporary 40mph limit in roadworks on the A303.

She challenged the prosecution using photographic evidence and a report from a sign expert.

The case was dismissed by Salisbury Magistrates' Court on 17 February because of a lack of evidence from the Crown Prosecution Service (CPS).

The CPS added that it had "decided to withdraw further speeding prosecutions" for the period the roadworks were in place.

In the first six weeks of the enforcement a police statement said more than 5,600 motorists were caught breaking the 40mph limit.
