If I knew that the person had been drinking I wouldn't be in the car in the first place.
If I felt that the person hadn't seen an upcoming red light I would tell them.
If I could tell that person was planning to do so beforehand I'd say something. If I was caught unawares, I wouldn't say anything during. I'd say something afterwards. If it happened again, I'd probably walk.
Got it in one. I NEVER obey "The Law" just because it is "The Law". I have a mind of my own and will use my own judgement as to whether I think it is right and proper to behave that way. Sometimes it's the consequences of being caught that may be the determining factor. It is NEVER just because it is "The Law". There are very few "Laws" that I blatantly disregard. On the whole, my parents gave me a pretty reasonable value set to start with.
