uninsured in california accidentcoverage question 2866

Right. A few things here. Yes, it was her fault. This hasn't yet been determined by her insurance but I am confident that they'll be shouldering 100%. Let alone the fact that her pbuttenger refused to divulge personal information, but that's a different paragraph. Also, an uninsured motorist gives up all rights to pain and suffering, so the most I could hope for would be medical bills which aren't necessary. Not an issue. It was a glancing hit that did more damage to her car than mine.

Thirdly, insurance doesn't really care. I talked to their insurance yesterday and they'd already reported it to the DMV, so there's nothing I can do about that. If it's their fault they'll cut me a check and we'll be done. If somehow they figure I was partially at fault, then they'll ask me for money. And so it goes. The issue is the law that says that an uninsured motorist who gets in an accident receives and automatic 1yr suspension. That's what I'm trying to avoid despite the sentiments of certain individuals 'round these parts.

The below are lay opinions; someone in this situation may wish to consult an attorney. Looks like a possibility...

We're on the same page here. Chaos wins out this time, though.
